Terms of Service

These terms are an agreement between you and [Company legal name], registered at [Registered address] (“Mishkim”, “we”, “us”). They cover your use of the Mishkim web app and this website (the “service”).

By creating an account or using the service you agree to these terms and to our Privacy Policy. If you use the service for a business, you confirm you can agree on its behalf, and “you” means that business too.

Mishkim uses AI to generate images and video from reference photos you upload. You can create product photographs, virtual try-on images of a garment worn by a person, reusable AI “models” (synthetic people you design once and use again), and short videos. The service is a web app; there is nothing to install.

We are improving the service all the time, so features may be added, changed or removed. We will not remove something you have paid for in the current period without telling you first.

• You must be at least 18 years old to use the service.
• Give us a real email address you can receive mail at, and keep your password to yourself.
• You are responsible for everything that happens under your account. Tell us at sales@mishkim.ai straight away if you think someone else has got into it.
• An account belongs to one workspace. Do not share, sell or transfer it.

Plans. Plans are monthly subscriptions. Each billing period grants a set number of credits: Starter at $29/mo (350 credits included); Pro at $99/mo (1,400 credits included). Enterprise pricing is agreed separately in writing. You can also buy one-off top-ups: 100 credits for $9.00, 500 credits for $40.00, 2000 credits for $150.00.

Paid trials. A trial is not free. The Starter trial: $4.99 today for 7 days and 60 credits, then Starter at $29/mo; the Pro trial: $9.99 today for 7 days and 150 credits, then Pro at $99/mo. You are charged the trial price when the trial starts. When the trial ends it renews automatically into the full plan, at its monthly price, unless you cancel before the trial ends. Each workspace can take one trial.

Access. Generating anything needs an active plan or trial, or credits left on your balance.

Who takes your payment. Payments are processed by Dodo Payments, which acts as the Merchant of Record. That means Dodo Payments is the seller of record for your purchase: it charges you, handles sales tax and VAT, and holds your payment details. We never see or store your card number. Your purchase is also subject to Dodo Payments’ own terms.

Renewal. Subscriptions renew automatically at the end of each period, and you authorise the charge for each renewal until you cancel.

You can cancel a plan or a trial at any time from the Billing page, in one click. Cancellation takes effect at the end of the period you have already paid for (or at the end of the trial). You keep access until then, and you will not be charged again.

Credits already granted to you stay usable after you cancel, until your account is closed.

• Credits are how the service is priced. Each image, AI model and second of video costs a number of credits. The rates published on the Billing page at the time you generate are the rates that apply.
• Credits have no cash value. They cannot be exchanged for money or transferred to anyone else.
• If a generation fails, the credits it used are refunded to your balance automatically.
• If a payment is refunded or charged back, the credits it bought are taken back off your balance (held while a chargeback is open). That can leave your balance below zero until it is covered.
• We may change prices or credit costs. We will give you notice before a change affects a plan you are on, and a change never applies to a generation you have already run.

Because Dodo Payments is the Merchant of Record, refunds are handled under Dodo Payments’ refund policy and the consumer law that applies to you. Top-ups and credits you have already used are generally not refundable, except where the law says they must be. If you think you were charged in error, write to us at sales@mishkim.ai and we will help you sort it out.

Uploads. You keep ownership of everything you upload.

Outputs. As between you and us, you own the images and videos you generate, to the extent the law allows. In some countries AI-generated material may not be protected by copyright at all, and similar outputs may be generated for other people, so we cannot promise that anyone else is prevented from using something similar.

Our licence. You give us a licence to store, process, copy and display your uploads and outputs only as needed to run the service for you: to generate what you ask for, keep it in your workspace and show it back to you. This includes sending them to the providers listed in our Privacy Policy for that purpose. The licence ends when the content is deleted.

No training. We do not use your uploads or outputs to train AI models.

When you upload something or use what you generate, you confirm that:

• You have the rights to what you upload, including the product itself, its design, its branding and any logos or trademarks on it.
• If you upload a photo of a real person, for example as a reference for a model or a try-on, you have that person’s consent to use their likeness this way.
• You follow the rules of the marketplaces, ad platforms and shops where you publish outputs, including their rules on AI-generated imagery. Some require that photorealistic AI-generated people are disclosed (Amazon does, for example).
• You follow the AI-disclosure laws that apply to you, such as labelling synthetic people or AI-generated content where the law requires it (for example, Article 50 of the EU AI Act).
• You check every output before you use it. Your product listings and ads must describe what the customer will actually receive.

You must not use the service to create, upload or share anything that:

• is unlawful, or infringes someone else’s intellectual property or privacy;
• sexualises minors in any way, or is sexual content involving a real person without their consent;
• impersonates a real person, or uses their likeness, without their consent;
• is deceptive, for example a product image that misrepresents what the buyer will get, or fake reviews, endorsements or evidence;
• is hateful, harassing, violent or threatening;
• promotes goods or services that are illegal where they are sold.

You also must not try to break, overload or get around the service’s security, access other people’s workspaces, scrape it, resell access to it, or use it to build a competing product. The AI providers we use also refuse some requests under their own policies, and a refused request is treated like any other failed generation.

AI outputs are generated, not photographed. They can be inaccurate, and the same request can produce different results. We do not promise that an output will match your product exactly in colour, shape, size, text or detail. It is your job to review outputs and decide whether they are fit to use.

You can stop using the service at any time, and you can ask us to close your account by writing to sales@mishkim.ai.

We may suspend or close your account if you seriously or repeatedly break these terms, if you do not pay, or if we have to by law. Where it is reasonable, we will warn you first and give you a chance to fix the problem.

We work hard to keep the service running and useful, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose. Nothing in these terms takes away rights you have under consumer law that cannot be excluded.

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue, data or goodwill.

Our total liability to you for all claims arising from the service is limited to the amount you paid us in the 12 months before the event that led to the claim.

None of this limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

If someone makes a claim against us because of content you uploaded, how you used an output, or your breach of these terms, you agree to cover the costs, damages and reasonable legal fees that result. We will tell you about the claim promptly and let you take part in handling it.

We may update these terms. If a change is significant, we will tell you by email or in the app before it takes effect. The date at the top of this page shows when they last changed. If you do not agree to a change, you can cancel before it takes effect; carrying on using the service after that means you accept it.

These terms are governed by [Governing law and jurisdiction], and disputes will be heard by the courts there. If you are a consumer, you also keep the protection of the mandatory laws of the country you live in and can bring a claim in your local courts.
